OFFICIAL RULES
1. Eligibility and Sweepstakes Details. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE SWEEPSTAKES ENTRY PERIOD. The LPGA Pro Shop Online Sweepstakes (“Sweepstakes”) begins at 10:00 AM Eastern Time (ET) on July 24, 2008 and ends at 10:00 AM (ET) on August 30, 2008 (“Sweepstakes Entry Period”). The Sweepstakes is open to legal residents of the United States and the District of Columbia, age 18 and older who have a valid email address at time of entry. Void where prohibited by law. Sponsor: Ladies Professional Golf Association (“LPGA”), 100 International Golf Drive, Daytona Beach, FL 32124. Employees of the LPGA, their subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies and any other individual or company involved in the development or execution of the Sweepstakes, and members of their immediate families (parent, child, sibling and their respective spouses) of same households, whether or not related, are not eligible to enter.
2. Acceptance of Official Rules. By participating in the Sweepstakes, you (“Entrant”) agree (i) to be bound by these Official Rules, including all eligibility requirements, and (ii) to be bound by the decisions of LPGA, which are final and binding in all matters relating to the Sweepstakes. If you disagree with the terms of these Official Rules, do not submit an official online entry form. Failure to comply with these Official Rules may result in disqualification, as described herein or as otherwise determined by the LPGA, in its sole discretion.
3. How to Enter. To enter, visit www.LPGAproshop.com (“Website”) and follow all online entry instructions to complete and submit the official online entry form during the Sweepstakes Entry Period. No other method of entry is acceptable. Only properly completed official online entry forms will be accepted. Limit: one (1) entry per person per email address per week during the Sweepstakes Entry Period regardless if Entrant has more than one email address. Although subsequent attempts to enter may be received during the Sweepstakes Entry Period, only the first entry received from a particular individual email account per week will be eligible; subsequent attempts thereafter will be disqualified. Online entries must be received by 10:00 AM ET on August 30, 2008. Proof of sending or submission will not be deemed to be proof of receipt by the LPGA. Online Entrants are subject to all notices posted at www.lpga.com, including but not limited to the privacy policy. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Entrants are responsible for notifying the LPGA of changes in email addresses.
4. Entrant Conduct. The LPGA is not responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Sweepstakes, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, and may subject that Entrant to disqualification. LPGA is not responsible for lost, late, unintelligible, damaged, illegible, garbled, inaccurate, invalid, misdirected, returned, undelivered or incomplete entries, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (“ISP”), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. All entries become the property of the LPGA and will not be returned or acknowledged. Persons who tamper with or abuse any aspect of the Sweepstakes or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate the Website terms of service, as solely determined by the LPGA, will be disqualified. The LPGA is not responsible for injury or damage to participants’ or any other person’s computer or property related to or resulting from participating in this Sweepstakes. Should any portion of Sweepstakes be, in the LPGA’s sole opinion, compromised by virus(es), worm(s), bug(s), unauthorized human intervention or other causes which, in the sole opinion of the LPGA, corrupt or impair administration, security, fairness or proper play of this Sweepstakes, or submission of entries, the LPGA reserves the right, at its sole discretion, to suspend, modify, or terminate the Sweepstakes, and randomly select the winners from valid entries received prior to such compromise, or otherwise as may be deemed fair and equitable by the LPGA.
5. Sweepstakes Prize. Prize and its Approximate Retail Value (“ARV”): An LPGA Golf Bag (ARV: $225.00). One (1) Grand Prize Winner (“Winner”) will be awarded the prize “as is” with no warranty or guarantee, either express or implied by LPGA. Winners may not substitute or transfer the prize, but the LPGA reserves the right to substitute the prize (or portion thereof) with another prize of comparable or greater value, at its sole discretion or due to unavailability. The prize may not be redeemed for cash.
6. Selection of Winner. The potential Winner will be selected in a random drawing from among all eligible entries received. If the Winner is deemed ineligible, the prize shall be automatically forfeited without notice and the LPGA reserves the right to select another Winner. A random drawing will be conducted on or about September 3, 2008 at 10:00 A.M at LPGA headquarters by the LPGA, whose decisions are final. Potential winner will be notified via mail/e-mail. If mailing address is not available, potential Winner will be notified by email to obtain his/her mailing address. Two attempts will be made to contact the potential Winner within the 7-day period. If the potential Winner fails to respond within a 5-day period, or if the e-mail attempt is consistently returned as undeliverable, the potential Winner will be disqualified and an alternate Winner will be selected. When the potential Winner’s mailing address has been obtained, s/he will be notified via delivery service. Potential winner will be required to complete, sign, and return an Affidavit of Eligibility/Liability, Publicity Release, and any other appropriate legal documents, which must be notarized and returned within 14 days of date printed on notification; otherwise, an alternate winner will be selected. If prize notification letter is returned as undeliverable or if prize is forfeited, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. Winner is solely responsible for taxes and fees, if any, associated with the winning prize.
7. Use of Name/Image. Except where prohibited by law, entry and acceptance of prize constitutes permission to use winner’s name, biographical information, prize won, hometown and likeness for purposes of advertising and publicity in any form of media now or hereafter devised including online posting, without additional notification, permission or compensation.
8. Limitation of Liability. By participating in the Sweepstakes, Entrant releases the LPGA, its subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies and an other individual company involved in the development and execution of the Sweepstakes, as well as the employees, officers, directors and agents of each from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Sweepstakes, or acceptance, possession, use or misuse of any prize awarded herein, including, without limitation, personal injuries, death and property damage. Under no circumstances will Entrant be permitted to obtain a judgment or award of, and Entrant hereby waives all rights to claim punitive, incidental, and consequential against LPGA. Additionally, all causes of action arising out of or connected with the Sweepstakes shall be resolved individually, without resort to any form of class action. The LPGA is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prizes. Entrant agrees that the laws of the state of Florida shall govern any and all disputes involving the Releasees. Any disputes involving the Releasees shall be resolved by arbitration, in the state of Florida, pursuant to the Commercial Rules of the American Arbitration Association then in force.
9. Winner Notification. For winner’s name (available after September 30, 2008) send a self-addressed, stamped envelope by September 30, 2008 to: LPGA Golf Bag Sweepstakes Winner, c/o LPGA, 100 International Gold Drive, Daytona Beach, FL 32124.
10. Email and Mailing List: By providing your personal information and email address, you agree to receive future information from the LPGA by either email or regular mail. 11. Notice: LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE LPGA RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
